When can I apply for Foreign Labor Certification through the Premium service?
In order to get my H1B visa for the 2009 FY, the first step for my employer is to get Labor Certification from the Department of Labor, I read there is a Premium Service where you can get the certification in 15 days by paying US1,000. Since the earliest day I can send my application for my visa is on April 1st, 2008…is there a specific time I must apply for this premium service to be done or can it be done anytime during the year?

1. It’s not labor certification, thats for permanent residence, it’s labor condition and that is done in about two minutes. The Department of labor does not have premium processing, immigration (USCIS) does.
2. Premium processing is for the I-129 application, the H1b visa. You have to wait until right before April 1, 2008 to send it and the premium processing application is sent at the same time as the I-129.
3. There is no way to get ahead in the process other than prepare the applications and put them in an envelope with the address and wait until March 29.
4. If next year is anything like this one, the extra $1,000 will be wasted, you won’t get the visa unless you get lucky, and by the time you find out, way more than two weeks will have passed.
There is no premium processing for labor certification. they are approved pretty quickly anyway. you can premium process the I-140, the second stage of the green card process
