Public Workers v. Mitchell//Hatch Act of 1939?

Question by mimi: Public Workers v. Mitchell//Hatch Act of 1939?

***Public Workers v. Mitchell***
***Hatch Act of 1939***

I’m not quite getting this. Does this mean the above laws/decisions mean that the federal executive branch employees (all federal employees are in the executive branch, though, right?) are prohibited from engaging in politics? How would you define “engaging in politics”? Also, any ideas why it it a threat to the Ninth Amendment? I don’t see why engaging in politics violates other people’s basic rights if that’s why it is a threat….

Answer by INSOMNIAC
The Hatch Act of 1939 is a United States federal law whose main provision is to prohibit federal employees (civil servants) from engaging in partisan political activity. Named after Senator Carl Hatch of New Mexico, the law was officially known as An Act to Prevent Pernicious Political Activities.
The act precluded federal employees from membership in “any political organization which advocates the overthrow of our constitutional form of government.” During the Second Red Scare, this designation was interpreted to include communist and labor organizations. By engaging in politics they are referring to actively campaigning for an individual who is running for office but they can still vote.~

If you are laid off and than the place you were laid off from starts hiring for workers are they suppose to ca?

Question by Stephanie S: If you are laid off and than the place you were laid off from starts hiring for workers are they suppose to ca?
My husband was laid off over a year ago and is still collecting unemployment but it wasn’t anything near what he should have been making and now the company is hiring and they haven’t called him back to his job. Is that legal?

Answer by ckm1956
Legal, maybe. Morally right? No.

If he was unionized or had a contract, then his rights would be spelled out. If not, then he may be out of luck.

Have him call the company & ask. Can’t hurt.

You can always speak with an attorney that’s experienced in employment law.

Good luck.

Workplace Violence against Public Sector Healthcare Workers 2004 NIOSH.wmv

Recent data indicate that hospital workers are at high risk for experiencing violence in the workplace. According to estimates of the Bureau of Labor Statistics (BLS), 2637 nonfatal assaults on hospital workers occurred in 1999-a rate of 8.3 assaults per 10000 workers. This rate is much higher than the rate of nonfatal assaults for all private-sector industries, which is 2 per 10000 workers. Several studies indicate that violence often takes place during times of high activity and interaction with patients, such as at meal times and during visiting hours and patient transportation. Assaults may occur when service is denied, when a patient is involuntarily admitted, or when a health care worker attempts to set limits on eating, drinking, or tobacco or alcohol use. Workplace violence ranges from offensive or threatening language to homicide. NIOSH defines workplace violence as violent acts (including physical assaults and threats of assaults) directed toward persons at work or on duty. For more information on workplace violence issues and prevention in healthcare read the NIOSH publication, Violence Occupational Hazards in Hospitals available at www.cdc.gov . This is clipped from the 2004 video, Violence on the Job, from the National Institute for Occupational Safety and Health (NIOSH). This video discusses practical measures for identifying risk factors for violence at work, and taking strategic action to keep employees safe. It is based on extensive NIOSH research
