Towards the Single Employment Contract: Comparative Reflections

This book examines the concept of the single employment contract, which is designed to abolish or limit other types of permanent and temporary labor contracts. It presents the contract’s pros and cons, highlighting its virtues and revealing its inherent contradictions.

The authors lay out the general framework of the current debate over the single employment contract, outlining the origins of its proposal. They then review the differing views on labor market segmentation and the compromise “flexicurity” proposal —an attempt to conciliate flexibility and security in the labor market. They also examine the key characteristics of the single employment contract as well as the arguments for and against it. Case studies demonstrate how the idea has been taken up in France, Italy, and Spain.

The book concludes with a concise review of contractual arrangements in EU labor markets and of possible future projections and developments.

Unemployment Insurance and Non-Standard Employment: Four European Countries in Comparison

Non-standard employment forms have been gaining in importance in western European countries since the 1980s, with the growing labour market partici- tion of women and continuing mass unemployment. The promotion of more flexible employment in the form of part-time employment, temporary empl- ment and self-employment is seen as a possible solution to persistent unempl- ment, underemployment and also to the need to better reconcile work and family life. Flexible employment forms as a remedy for unemployment have in fact been actively promoted through labour market policies. Social insurance systems thus, by installing and preferring certain measures, contribute to the diffusion of insecure employment. In the context of the German Hartz reforms policy inst- ments that encourage self-employment (Ich-AG), marginal employment (Mi- and Midi-jobs) and temporary work agency employment (PSA), for example, have been introduced or broadened. Flexible employment forms are in many countries also promoted through incentives and subsidies or indirectly through changing the law in relation to employment rights (for country-specific examples see Rubery et al. 1998a: 188 et seqq.).

Employment Health Insurance Legality:?

Question by Brian B: Employment Health Insurance Legality:?
Hi everyone. I just need some advice about a legal situation. Please only answer if you are sure.

I know someone who is listed as an employee of a company that a family member owns. He/she does not actually render any services, but pays taxes on the income, and reports all wages to the federal government. He/she gives all money earned to his/her boss, who owns the business by himself.

The reason for this “employment” is medical insurance. The person involved would not have otherwise been able to afford prescription medications and surgery. So the family member offered to put him/her on payroll so that he/she would be covered under a cheaper health insurance policy.

Is this situation legal? Is his/her boss allowed to put him/her on the payroll without him/her rendering services? If word of this situation were to get out, who would get introuble — the employee or the employer, or both? Is it fraud, or just a loophole in the system?

To me it seems like a loophole.

Best answer:

Answer by 65% water
If the person is truly not performing any service at all for the company then it is illegal to call them an employee. However, anyone can be designated as a “consultant,” and plenty of family-run businesses operate just this way.
