Even after the state has granted unemployment benefits, the company has the right to appeal. If the judge on the telleconference rules in their favor, the benefits paid to you by the state will have to be paid back. If however you can prove your case, then you can keep them. This is actually very common practice, but understand that the state would not have paid you if they hadn’t already ruled in your favor, which means you may have the stronger case in this situation.

The company will attempt to provide documentation and evidence to prove that you do not deserve the unemployment benefits. You need to prove that you either:

A: Quit, because you had no choice (i.e. you were in a hostile working environment that was not being addressed)

or

B: Were fired due to no fault of your own. You did not break any company policy and you were simply laid off or let go due to some other reason.

If they can prove that you did in fact quit without needing to or if you were fired due to “misconduct”, then they will win the case. I suggest you get a good idea of what you want to say before hand, as you will have the opportunity to ask questions and be asked questions during the process.

Hope this helps!

My Question is, if im still Unemployed after EUC runs out, can I apply for Unemployment again?

Best answer:

Answer by Judy
You might br eligible for additional tiers of extended benefits. Once you use up all the tiers you’re eligible for, you can’t get more unemployment benefits until you qualify again by working a certain length of time – then if you get laid off again, you might qualify.
