I am getting ready to rent a home located in McKinney , TX. How do I find out if this home is in foreclosure?

Check with the Recorder/clerk’s office. Whoever it is that records deeds. They will have liens filled against the property which will include foreclosure actions.

Check the courthouse records…they are public.
PS: You are a smart girl.
You might check with the county recorder’s office in which the property is located. This will give you the current recorded information about the property.
The one thing checking the county court records to find out if the lender has filed a notice of default, you will not know if the current owner has not paid his mortgage in the last several months, however, the lender might not have initiated foreclosure procedures as of yet.

You can never be 100% sure. You can check court records to see if a foreclosure has been filed but that is about it. If the owner is behind in their payments but the bank has not filed yet then you have no way of knowing that.
I know tenants are nervous about this with all the foreclosures lately, but tenants are protected. If you sign a lease before the foreclosure is complete then the bank is required to honor it. If you move in but do not have a lease they are required to give you 90 days notice.
