I am a teacher and I recently got laid off due to budget cuts. I recently received a form from the Unemployment claims department asking questions about my position and what happened to it because apparently teachers are not allowed to receive benefits during standard breaks, vacations, etc. However, I don’t think this applies to laid off teachers because we have no guarantee of if or when we will be going back to work. Does anybody know the answer to this question?

That is a very interesting question. First off some teachers get paid nine months and some teachers get paid 12 months, not sure if that makes a difference. I would definately file an unemployment claim asap. Some teachers work summer school, so if nothing else you are being shorted that amount. It is importanat to file asap because if you wait, you dont get compensated for the time you stalled. If you file and then you later find out you were not suppossed to get the money, I am certain that they will ask for it back. If you dont like what the person at the claims dept is saying call back and talk to another one, you might get a different answer if the first one is unsure.

Your contract was for the 9-month school year, so even if your salary is paid over a 12-month time span, you are no longer earning money. You are unemployed, since you do not have a job to go back to in the fall.
It is important to complete all the paperwork in a timely manner to ensure that you receive the benefits to which you are entitled. Hopefully, you will not need to be receiving them very long. :0
